DE C.V. in order to inform you about how the information you provide will be handled, as well as how you can limit the use of the data collected. ANIMATED ENGINEERING S.A. DE C.V., hereby provides you with this PRIVACY NOTICE, hereinafter NOTICE in order to ensure the right to informational self determination, privacy, and respect, as well as our obligations regarding the proper use of the information provided by individuals who share their personal data with us.

We would therefore like to inform you that ANIMATED ENGINEERING S.A. DE C.V., through its legal representative, is the owner of the website http://www.dinosauriosmexico.com/ (hereinafter “ANIMATED ENGINEERING”) and is responsible for the handling of personal data; as such, it recognizes and prioritizes the privacy and confidentiality of any information it currently holds or may come to hold, whether temporarily or permanently, including personal data or information. In order to comply with the provisions of the LFPDPPP, it has decided to establish a Personal Data Protection Office within its organizational structure, which you can contact via email at [email protected]

We would therefore like to inform you that “ANIMATED ENGINEERING”. is responsible for the handling of personal data, and therefore recognizes and prioritizes the privacy and confidentiality of any information it currently holds or may come to hold, whether temporarily or permanently, including personal data or information.

“ANIMATED ENGINEERING” acknowledges that all personal information in its possession has been provided freely and voluntarily by the individuals concerned and/or has been obtained lawfully through appropriate legal means, in accordance with the principles of privacy and confidentiality, in order to ensure the security and protection of such information.

Therefore, “ANIMATED ENGINEERING”. In its capacity as the controller of personal data, it adheres to the principles of lawfulness, consent, information, data quality, purpose limitation, fairness, proportionality, and accountability, as established by “THE LAW”. In this regard, we would like to inform you of the following:

The personal data we collect from users to fulfill the purposes described in this “NOTICE”, are collected directly when you provide them to us in person, through our websites, mobile apps, or portals “ANIMATED ENGINEERING”, by phone and email, and when we obtain information through other publicly available sources permitted under “THE LAW” and its implementing regulations.

You can access our website without providing any personal information; however, there are certain sections of the site where you may voluntarily provide your information. The data we collect directly in person, online, via email, and by phone includes the following: full name, photo, date of birth, educational background, customer number, nationality, phone number, cell phone number, email address, home address, age, and government-issued ID.

With regard to financial or asset-related data, such as the Federal Taxpayer Registry (RFC), tax address, credit or debit card number, credit or debit card expiration date, credit or debit card security code, and the name of the credit or debit cardholder, account number, and interbank code, by using this information to purchase any of our products or services, you expressly consent to the processing of this data in accordance with the provisions of Article 8 of “THE LAW”.

3. From suppliers:

The data we collect directly in person, online, via email, and by phone includes the following:

For individuals: Full name, photo, official identification, proof of address, date of birth, marital status, nationality, phone number, email address, marriage certificate (in certain cases), signature, Taxpayer Identification Number (RFC), tax address, and account number or bank routing number.
For legal entities: Name or business name, articles of incorporation, document(s) setting forth the powers of the legal representative or agent, registered office, proof of address, official identification of the legal representative or agent, signature of the legal representative or agent, Taxpayer Identification Number (RFC), tax address, and account number.

With regard to financial or asset-related data, such as the Tax Identification Number (RFC), tax address, and account number mentioned above, by entering into the relevant legal transaction, you are deemed to be giving us your express consent to process this data.

Since “THE LAW” permits other sources of information, such as physical or electronic telephone directories and service directories, the data we can obtain through these means includes first and last names, telephone numbers, email addresses, and physical addresses.

Your data may also be collected in various situations, such as when you choose to provide us with your resume, when you send us an email, when you sign up to receive information of interest or subscribe to our blog, as well as any data you provide to us with a view to establishing a business relationship. The personal data we may collect in these circumstances falls into the following categories:

A. Personal information: name, home address, date of birth, landline and/or cell phone number, fax number, email address, photo, CURP, NSS
B. Academic information: educational background, degree, professional license number, specialty, certificates.
C. Employment information: job title, address, email address, landline or mobile phone number, and fax number.
D. Billing information: entity to be charged, tax address, Tax ID Number.
E. Financial information: bank account details, payment method

The information mentioned above may be collected through the following channels: contact form, email ([email protected]), or in person, etc. At “ANIMATED ENGINEERING” we receive inquiries from potential clients interested in our services, so we have access to the contact’s name, email address, phone number, address, and/or company name for future communications starting from the first contact.

4. MINORS, PERSONS LACKING LEGAL CAPACITY, AND SENSITIVE PERSONAL DATA:

“ANIMATED ENGINEERING”. We do not collect any kind of sensitive personal data that pertains to your most private sphere, or whose misuse could lead to discrimination or pose a serious risk to you, nor do we collect data that could reveal aspects such as racial or ethnic origin, current or future health status, genetic information, religious, philosophical, or moral beliefs, political affiliations or opinions, or sexual orientation. The foregoing is in accordance with the provisions of the LAW.

In addition, we wish to inform you that the personal, employment, commercial, legal, property, and financial data (hereinafter collectively referred to as “PERSONAL DATA”) that you provide to “ANIMATED ENGINEERING” will be processed for the following primary purposes.

Purposes that gave rise to and are necessary for the existence, maintenance, and fulfillment of the legal relationship between the data subject and “ANIMATED ENGINEERING”as well as for billing purposes; secondary purposes such as statistics, personal safety, credit and payment verification, and assessment of transaction fraud risk. For the purposes of your safety and that of other providers when offering a service and/or product, you may be videotaped or photographed.

With regard to the use of personal data provided by the data subject, “ANIMATED ENGINEERING” is committed to collecting such data in accordance with the purposes set forth in this privacy notice, as required by the LFPDPPP and applicable commercial contracts, and does not process or use the data for any purpose other than, or that is not compatible with or analogous to, the established purposes, the foregoing in compliance with Article 12 of the aforementioned law.

V. Restrictions on the Use of Data

VII. VIDEO SURVEILLANCE AND SECURITY CAMERAS.

As an additional security measure “ANIMATED ENGINEERING”has a closed-circuit television (CCTV) system. The images and audio captured by the surveillance cameras are confidential and are used solely to ensure the security of our facilities and visitors, and as evidence in any relevant investigations. These recordings are retained for the period required by law.

VIII. USE OF TRACKING TECHNOLOGIES.

IX. ARCO Rights.

You or your duly authorized legal representative may restrict the use or disclosure of your personal data. To do so, you may exercise, where applicable, the rights of Access, Rectification, Cancellation, or Objection hereinafter referred to as “ARCO RIGHTS” provided for by the "LAW" by submitting a written request in Spanish to the address or email address indicated above; It is important to note that the exercise of any of the “ARCO RIGHTS”does not preclude the exercise of another right.

Access.- You have the right to be informed about which of your personal data is contained in the databases of “INGENIERÍA ANIMADA,” the purposes for which such personal data is used, the source of the data, any communications made using it, and, in general, the conditions under which such data is processed.
Correction.- To have your personal data corrected or updated if it is inaccurate or incomplete.
Cancellation.- The data subject has the right, at any time, to request that “ANIMATED ENGINEERING” delete their personal data.
Opposition.- To object, on legitimate grounds, to the processing of your personal data.

X. Mechanisms for Exercising ARCO Rights.

The exercise of “ARCO RIGHTS” as well as the revocation of your consent to the processing of your personal data must be carried out by submitting the corresponding request, which must be in writing and in Spanish and submitted by the data subject or their legal representative to the DATA PROTECTION OFFICE OF “ANIMATED ENGINEERING”via email to the address [email protected] addressed to the aforementioned OFFICE.

Your application must include your full name, a clear, legible, and valid copy of your official identification, or, if submitting electronically, a scanned copy thereof. If the application is submitted by your legal representative, you must include official documents proving such representation, along with the email address or physical address you designate for notifications and a contact phone number.

If the information provided in your request is incorrect or insufficient to process it, or if the required supporting documents are not included, you will be notified within five business days of receipt of your request to provide the necessary information or documents to process it. You will have ten business days to comply with this request, starting from the day after it was issued by the DATA PROTECTION OFFICE OF “ANIMATED ENGINEERING”. Once the requirements outlined above have been met, within a maximum of twenty business days from the date of receipt of your request regarding “ARCO RIGHTS”and the revocation of personal data processing, the DATA PROTECTION OFFICE OF “ANIMATED ENGINEERING”will respond regarding the validity of your request via email sent to the email address you provided in the request itself, or by sending a letter to the physical address you provided for this purpose (the twenty-day period will be deemed fulfilled upon delivery of the document to the postal service). If the request is deemed valid, it will take effect within fifteen business days following the date on which the response regarding its validity is communicated.

XI. Grounds for denying access to, rectification of, erasure of, and objection to the processing of the personal data you have provided.

At any time, the data subject or their legal representative may exercise any of their rights of access, rectification, erasure, or objection (ARCO rights) and/or revoke their consentin accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter “LFPDPPP”) and applicable commercial contracts.

“ANIMATED ENGINEERING”. may deny you (i) access to your personal data, (ii) the right to correct such data, (iii) the right to have such data deleted, or (iv) the right to object to the processing of such data in the following cases:

I. When you are not the data subject of the personal data you are requesting.
II. When the personal data you have requested is not found in our databases.
III. When the rights of a third party may be affected.
IV. When there is a legal impediment or a decision by an authority to that effect
V. When the correction, deletion, or objection has already been made.

In any of the cases mentioned above, “ANIMATED ENGINEERING”will have no more than 20 days to inform you of the reason for its denial.

“ANIMATED ENGINEERING” declares that it complies with the security and confidentiality obligations set forth in Articles 19 and 21 of said Law through its Quality and Security Management Systems. And that in cases where “ANIMATED ENGINEERING” has not obtained the data directly from the data subject, it is understood that the data subject tacitly consents to the processing of their data, provided the data subject does not object to the provisions of this notice, in accordance with Article 8 of the LFPDPPP.

Finally, “ANIMATED ENGINEERING” maintains strict confidentiality regarding personal data even after its contractual relationships with its clients have ended.

DEFINITIONS.

Below, “ANIMATED ENGINEERING”provides a brief glossary of some of the terms used herein to ensure a full understanding of the Privacy Notice made available to you. This is without prejudice to the definitions set forth in Article 3 of the Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations.

III. Days. – Pursuant to Section 3(VII) of the Federal Law on the Protection of Personal Data Held by Private Parties, the time periods and deadlines specified in days shall be counted in business days.

VII. Transfer.- Any disclosure of personal data within or outside Mexican territory to a person other than the data subject, the data controller, or the data processor.
VIII. Exclusion List.- This is a database designed to register, free of charge, data subjects who do not want their information processed by the data controller for certain purposes, in order to prevent such processing.
